LuvlyFans Affiliate Programme Terms

These Affiliate Programme Terms ("Terms") apply to anyone who participates in the LuvlyFans Affiliate Programme ("Affiliate Programme").

By registering for or participating in the Affiliate Programme, you agree to these Terms.

1. The Affiliate Programme

The LuvlyFans Affiliate Programme allows approved affiliates to promote LuvlyFans using a unique referral link or other tracking method provided by LuvlyFans.

Affiliates may earn commission when they successfully refer creators to LuvlyFans and those creators meet the requirements for an active referral.

2. Referral and Active Referral

A referral is created when a new creator joins LuvlyFans through an affiliate's unique referral link or other approved tracking method.

A referred creator must complete LuvlyFans' applicable registration, verification and approval requirements.

A referral does not automatically become an active referral simply because a creator registers or is approved.

A referred creator becomes an Active Referral when they have been approved by LuvlyFans and begin generating qualifying earnings on the platform.

LuvlyFans may determine whether activity qualifies for the purposes of the Affiliate Programme.

3. Affiliate Commission

The standard affiliate commission is 5% of qualifying earnings generated by an Active Referral.

Commission is available for a period of 365 days from the date the referral becomes an Active Referral.

After the 365-day commission period ends, no further commission will be payable for that referral unless LuvlyFans has agreed to extend the commission period.

Any extension is discretionary and must be agreed by LuvlyFans. An extension may be agreed for an individual referral or in accordance with a separate arrangement with an affiliate.

Unless expressly agreed otherwise in writing, affiliate commission does not continue indefinitely or for the lifetime of a referral.

4. Qualifying Earnings

Commission is calculated on qualifying earnings generated by the Active Referral in accordance with the Affiliate Programme.

Refunded, reversed, fraudulent, disputed or otherwise non-qualifying transactions will not generate affiliate commission.

LuvlyFans may adjust or reverse commissions where the underlying transaction is subsequently cancelled, refunded, charged back or determined to be invalid.

5. Referral Tracking

Each affiliate is provided with a unique referral link or tracking mechanism.

LuvlyFans will use its affiliate tracking system to determine whether a creator has been referred by an affiliate.

LuvlyFans is not responsible for referrals that cannot be properly attributed because of circumstances including incorrect links, deleted cookies, browser restrictions, technical issues or other circumstances outside our reasonable control.

Affiliates must not attempt to manipulate, alter or interfere with affiliate tracking.

6. Self-Referrals and Artificial Activity

Affiliates must not use their own affiliate link to generate commission from their own accounts or activity.

Affiliates must not create, arrange or encourage artificial referrals, accounts, transactions or activity for the purpose of generating affiliate commission.

LuvlyFans may withhold or reverse commissions and suspend or terminate an affiliate account where self-referral, fraudulent activity or manipulation is identified.

7. Promotional Rules

Affiliates may promote LuvlyFans through legitimate websites, social media accounts, communities, content and other lawful marketing channels.

Affiliates must not:

• Make false, misleading or exaggerated claims about LuvlyFans, its services or potential earnings.
• Guarantee income, earnings or results from joining or using LuvlyFans.
• Represent themselves as LuvlyFans, an employee of LuvlyFans or an authorised representative unless expressly authorised.
• Create websites, social media accounts or profiles designed to impersonate LuvlyFans.
• Use misleading domain names, usernames, advertisements or branding that could cause confusion with LuvlyFans.
• Send unsolicited bulk emails, messages or direct messages promoting LuvlyFans.
• Use spam, bots, automated accounts or other artificial methods to generate referrals.
• Use misleading redirects, forced clicks, hidden links or other methods designed to manipulate tracking.
• Bid on or purchase search advertising using LuvlyFans trademarks or brand terms where this has not been expressly authorised.
• Make claims about LuvlyFans that have not been provided or approved by LuvlyFans.
• Promote LuvlyFans in a way that violates the rules of the platform or website being used.
• Use promotional methods that are unlawful or that could reasonably damage the reputation of LuvlyFans.

8. Adult Content and Promotion

LuvlyFans operates a creator platform that may contain adult-oriented content.

Affiliates are responsible for ensuring that their promotional activity complies with applicable laws, regulations, age restrictions and the rules of the platform or advertising network being used.

Affiliates must not promote LuvlyFans to children or knowingly target individuals who are under the applicable legal age.

Affiliates must not use sexual or adult promotional material in a way that violates the policies of the website, social network, advertising platform or community where the promotion appears.

9. Use of the LuvlyFans Brand

LuvlyFans may provide approved logos, images, promotional materials or other brand assets for affiliate use.

These materials may only be used to promote LuvlyFans through the Affiliate Programme.

LuvlyFans may request that an affiliate remove or change promotional material that it considers misleading, inappropriate or inconsistent with the LuvlyFans brand.

10. Disclosure

Where required by applicable law or the rules of the platform being used, affiliates must clearly disclose that they may receive a commission from referrals.

Any disclosure should be clear, noticeable and understandable to the audience.

11. Payments

Affiliate commissions are subject to any minimum payment threshold, payment schedule and payment requirements displayed within the Affiliate Programme.

Affiliates are responsible for providing accurate payment information.

LuvlyFans may delay or withhold payment where additional verification is required, where there is a suspected violation of these Terms, or where a referral or transaction is subject to investigation.

Affiliates are responsible for any taxes, reporting obligations or other charges applicable to their affiliate earnings.

12. Fraud and Abuse

LuvlyFans may investigate referrals, transactions and affiliate activity where there is a reasonable concern about fraud, abuse, manipulation or violation of these Terms.

Where prohibited or fraudulent activity is identified, LuvlyFans may:

• Cancel or reverse commissions.
• Withhold unpaid commissions.
• Suspend the affiliate account.
• Terminate participation in the Affiliate Programme.
• Restrict future participation in the Affiliate Programme.
• Take further action where appropriate.

13. Termination

Either you or LuvlyFans may end participation in the Affiliate Programme.

LuvlyFans may suspend or terminate an affiliate account immediately where it reasonably believes that the affiliate has breached these Terms, engaged in fraudulent or abusive activity, or otherwise created a risk to LuvlyFans, its users, creators or reputation.

Following termination, you must stop using LuvlyFans affiliate links and promotional materials provided through the Affiliate Programme.

Unless otherwise determined by LuvlyFans, legitimately earned commissions relating to qualifying activity before termination remain subject to these Terms.

14. Changes to the Programme

LuvlyFans may update the Affiliate Programme, including commission rates, qualifying conditions, payment arrangements and other programme features.

Where material changes are made, LuvlyFans may provide notice through the Affiliate Programme or other appropriate communication channels.

Any commission already earned before a change will remain subject to the applicable terms at the time it was earned, unless otherwise required by law or agreed with the affiliate.

15. No Guarantee of Earnings

Participation in the Affiliate Programme does not guarantee any particular level of income, referrals or commissions.

Affiliate results will vary depending on factors including audience, promotional activity, traffic, referrals and creator activity.

LuvlyFans does not guarantee that any affiliate will earn a particular amount.

16. Relationship Between LuvlyFans and Affiliates

Participation in the Affiliate Programme does not create an employment relationship, partnership, joint venture or agency relationship between you and LuvlyFans.

Affiliates are independent participants and do not have authority to make commitments or representations on behalf of LuvlyFans.

17. Limitation of Responsibility

LuvlyFans will operate the Affiliate Programme using reasonable care but does not guarantee that the programme, tracking system or affiliate platform will always be available or error-free.

LuvlyFans will not be responsible for losses resulting from circumstances outside its reasonable control, including technical interruptions, third-party platform changes, tracking failures or changes to advertising platform policies.
